Terms and conditions
This English version is for information only. The Dutch version is legally authoritative.
In brief
- Work starts after you accept a written quote and pay a 30% deposit on the quoted amount.
- Free reschedule or cancellation is available until 5 days before the session; later rules are in article 7.
- Mix and master work includes 2 revision rounds as described on the service pages.
- Dutch law applies; consumers may also bring claims before courts in their EU country of residence where permitted.
1. Scope
These terms apply to all services provided by Monimiavyra B.V. (the studio) at Van Woustraat 78, 1074 LN Amsterdam. They cover recording, mixing, mastering, voice-over and related studio work as described on services and in an individual quote.
By accepting a quote (email, signature or payment of the deposit) you enter a contract with us. Only what is written in the quote deviates from these terms. Also read our legal notice and privacy policy. Business clients who supply third-party personal data may rely on the data processing agreement where relevant.
2. Definitions
| Term | Meaning |
|---|---|
| Client | The individual or company that accepts a quote. |
| Consumer | A natural person acting outside trade, business, craft or profession. |
| Business client | A label, publisher, agency or company booking professionally. |
| Quote | The written document stating service, date, duration, price including 21% VAT, deposit and any special terms. |
| Session | The reserved studio time with an engineer, or the agreed offline workflow. |
| Business day | Monday to Friday except public holidays in the Netherlands. |
3. Pre-contract information
Before you book, the site and quote show main service features, price, performance date, our identity, statutory guarantees and — for consumers — withdrawal rights where they apply. Guide prices on the site, such as €95 per hour for Vocal recording or €920 for a Live ensemble recording day, include VAT; the quote confirms the exact amount.
Practical articles in our guides, for example preparing for a vocal session or stem delivery specifications, are helpers and are not part of the contract unless the quote says so.
4. Quotes and booking
Requests via contact, 020 261 3847 or [email protected] receive a quote within 2 business days unless we need more details. A quote stays valid for 30 days unless stated otherwise. The slot is firm after acceptance and receipt of the deposit; until then we may assign it elsewhere.
For distance contracts we confirm the booking by email with the same details as the quote. We may refuse a request for legitimate reasons, such as unsafe setup, copyright issues or behaviour that harms the studio or other clients.
5. Prices and extras
Quote prices are in euros, including 21% VAT for consumers; business quotes may also show net amounts. Overtime beyond the reserved block is charged only if you confirm it in writing beforehand, at the hourly rate of the relevant service (for example €88 in studio for Mixing).
Travel, parking, hired musicians, special formats or rush delivery are excluded unless listed in the quote. Our disclaimer notes that artistic outcomes are not predictable.
6. Deposit and payment
When booking you pay 30% of the quoted amount as a deposit; it is offset against the balance. Consumers pay the remainder on the session day or when the final file is delivered. Business clients pay within 14 days of the invoice date unless agreed otherwise.
Payment by bank transfer; card in studio where available. Late payment on business accounts may incur statutory commercial interest and reasonable recovery costs. Until full payment we may withhold final files; working files are archived under article 12.
7. Reschedule and cancellation by the client
| Timing | Effect |
|---|---|
| More than 5 days before the session | Free reschedule or cancellation; on cancellation the deposit is refunded within 14 days. |
| From 5 days to 72 hours before start | One reschedule within three months; if no new date is set, the deposit covers reserved capacity. |
| Less than 72 hours or no-show | The deposit remains due except in force majeure. |
Send requests in writing to [email protected] or confirm a phone call by email. Arriving late shortens the session without extension if the next slot is booked. These rules do not limit statutory withdrawal where it applies.
8. Right of withdrawal (consumers)
If you are a consumer and conclude a distance contract (email, phone, form), you generally have 14 days to withdraw without giving reasons, from the day the contract is formed. This does not apply when the session is on a fixed date and you explicitly asked us to start before the withdrawal period ends — if you still withdraw, you pay a proportionate amount for work already performed.
Where the law allows, withdrawal is excluded for fully performed services after your express prior consent and acknowledgement that the right lapses, and for customised or clearly personalised work.
Withdraw by an unambiguous statement to [email protected] or by post to Van Woustraat 78, 1074 LN Amsterdam. We refund within 14 days using the same payment method unless you agree otherwise.
9. Cancellation by the studio
If we must cancel due to breakdown, essential staff illness or an incident on the premises, we inform you as soon as possible and offer a replacement date. If that does not suit you, we refund all sums paid within 14 days. We do not swap the assigned engineer without discussion.
10. Conduct, safety and age
The studio has 3 rooms, including a live room of about 44 m² and 2 iso booths. Sessions run within Wednesday–Friday 10:00–20:00, Saturday 11:00–16:00. Closed Sunday, Monday and Tuesday. by appointment. Minimum age to book independently is 16; younger artists are welcome with written consent from a parent or guardian who stays present.
Treat gear and rooms carefully and follow engineer instructions. No smoking or vaping indoors. We may pause or stop a session if people or equipment are at risk; the reserved time remains due. Damage through intent or negligence is charged to the client. Your own instruments and laptops remain at your risk.
We use moderate listening levels and provide hearing protection. For live planning see budgeting live hours.
11. Intellectual property
Your works. Compositions, lyrics and other material you supply remain yours or your licensors’. You warrant necessary rights on samples, covers and visuals and handle collective management notices. We claim no copyright in your music or text.
Recordings (neighbouring rights). Who initiates and is responsible for the recording is the producer under Dutch law. Because you order and pay for the session, that role is yours. To the extent we could be deemed producer, we assign producer rights on recordings made for you after full payment.
Performers. Fixing and exploiting performances requires performers’ consent. You arrange releases and credits for musicians, singers and voice talent you bring in.
Studio materials. Our methods, presets and internal templates remain ours. We do not use your recordings to train AI systems and create no voice clones without the person’s written consent.
References. We mention your name or project as a reference only with your written approval. See also release formats and rights.
12. Files, delivery and archive
Unless the quote says otherwise, we deliver stereo or multitrack files in common formats (usually 24-bit WAV) via secure download or on your media. Offline mixing and mastering start after we receive complete, usable stems as in stem delivery specifications.
We keep session and project files for 24 months after the last activity on the job, then delete them unless agreed otherwise in writing. You are responsible for your own backups within that period. Longer storage can be quoted separately.
13. Revisions
Mixing and mastering include up to 2 revision rounds as on the mixing and mastering pages. One round is a single bundled list of notes processed in one pass. Extra rounds or a new artistic direction after approval are quoted separately.
14. Liability
We perform work with the care expected of a professional recording studio. Artistic choices, preparation and commercial success remain yours; we do not guarantee chart placement or specific streaming algorithm behaviour.
Our liability is limited to direct, foreseeable damage from attributable breach, except where mandatory law provides otherwise (including death or injury through intent or conscious recklessness). For business clients total liability per job is capped at the invoiced amount including VAT, except for intent or gross negligence; indirect loss such as lost revenue is excluded.
Further context is in the disclaimer.
15. Personal data
We process personal data under the privacy policy. The contact form uses FormSubmit; see the legal notice on transfers. Manage cookie preferences via .
16. Complaints, disputes and law
Send complaints to [email protected] or our postal address. We respond within a reasonable time and aim for a practical fix. Consumers may bring disputes before competent courts in Amsterdam or, where law allows, in their country of residence.
The European Commission provides an online dispute platform: ec.europa.eu/consumers/odr. We are not obliged to join an alternative dispute body; we still handle complaints directly.
Dutch law governs these terms. Business disputes fall under the courts in the Amsterdam district unless mandatory forum rules say otherwise.
17. Final provisions
If a clause is void, the rest remains and we replace it with a valid clause closest to the intent. Failure to enforce a right is not a waiver. We may amend these terms; ongoing jobs keep the version at quote date. If languages conflict, the Dutch text prevails.
